We have a few unused Credit Card accounts that will remain unused because of high interest rates. If we cancel them it will mess up our credit score. whay shoulds we do , just sit on them?

The Answer : If you aren't paying any fees (annual or monthly) keep them and let them continue to help your scores.Just because they have a high rate of interest does not mean that you cannot use them.

As long as you pay in full when you get the statement, the interest will not affect you.Use them for something minor that you would normally pay cash for (like - gas, a hamburger, etc) and set the cash aside until you get the statement.

The Answer : You can start small and use shared hosting. If traffic becomes big, then you move to a dedicated server where only your site is in that box.

Or you can buy your own box and host your site yourself if you are capable Most of the big companies, in anticipation of traffic and the fact that they have investors and venture capital funds to back them up, buy and maintain their own servers.

They will use some third party services such as Akamai for load balancing, but most of the sites you mentioned are tech oriented sites so they already have techies on board who can maintain and create their own servers and not use services such as Go Daddy

I have to get my financial situation in order in 1 and 1/2 years. i have really bad credit and i need to pay it off and be able to buy a home. who do i call to help me figure out exactly what i need to do to reach my short term goals?

My brother had a car loan ($10,000) that he couldnt pay on anymore and had it repo'd. After trying to work with them, they decided to cut it off and take further actions. He hasnt received any letters but the last call was a wage garnishment threat. I know they have to take him to court and get a judgement first. He wants to know since in CA they can take up to 25% of his wages - can he fight that lower??? and HOW LONG does it take from the start of the last phone call to actually going to court???

He is not running from it, but wants to let his employer know ahead of time so they are not suprised and he also wants to lower his withholdings since he has other bills as well and needs to survive.

The Answer : I'm not sure of the exact procedure in California...but in many states it goes like this:1) Plaintiff files lawsuit.
You must be served and the court date is set. This can take 1-2 months depending on how efficient your court is. You can stall it another month by requesting another court date due to scheduling problems.2) The judgment is issued, and you have a certain amount of time to pay.

Generally this is 20-30 days.3) If not paid, plaintiff returns to court for order to garnish wages. This must be served on the employer, and you then have a time period to appeal it to the court (2-3 weeks).It is my understanding that garnishment schedules are pretty much set and you can't get them lowered.

You can, however, file a request for installment payments with the court. If approved, you will pay this amount outside of garnishment, and while you are making payments the plaintiff is prevented from garnishing your wages. In most states they can not go after bank accounts for file liens. But as soon as you miss a payment, the judge will grant a garnishment and you will not get it overturned.When you request installment payments, be prepared to have proof of your income and expenses.

The Answer : It depends on what type of bill you are talking about.I agree 100% with imthepretty1's advice on credit cards. You are expected to make monthly payments if you have any balance on the card. Any money paid is simply applied to the current balance, but they will generate a new bill the next month.
Fail to pay it and you are in all sorts of trouble.Car and/or mortgage payments are usually applied to the principal...but you can call and tell them to place it toward the next month's bill. Utilities are billed as they amount is occur, so by paying in advance you generate a credit balance. That will cover your future bills.

My boyfriend has bad debt, and cannot deal with the collection agencys abuse so we contacted American Credit Foundation http://www.debtguru.com/ which is a non profit credit counciling foundation that has agreed to make a payment plan so he can pay back the 2 creditors he owed. I figured this would give him a chance to build his credit back up. Will this hurt him?
I ask because we received a call from Omni Credit Services today and they said that is equivalent to bankcrupty. His dad is telling him that if he claims bankruptcy he would still be able to purchase a house within a few years. Whos right, whats his best options.

The Answer : Lots of poor, uneducated answers here!For starters, working with credit counseling is NOT the same as a consolidation loan. Credit counseling will hurt your credit, but not nearly as much as a bankruptcy.True, you could file for bankruptcy and qualify for a house in two years.....but that assumes that you are filing for a Chapter 7.

If you are a wage earner making more the the state allowance, you will not qualify for a Chapter 7, but instead be placed into a 13. You will be put on a 3-5 year payment plan to pay off a portion of the debts, and during that time you will not be allowed to incur further debts (like a mortgage).

I don't know your boyfriends situation...but stick with your payment plan for now. The advice about dishonest credit counselors is correct.

In some cases they may not cooperate with you. The Answer : Absolutely. If the mortgage wasn't paid off when you transferred title to your friend, then your friend got title subject to that mortgage, and the lender can absolutely foreclose if it's defaulted on. In fact, most mortgages have a "due on sale" clause to prohibit people from assuming their loans, so your lender could likely call the mortgage due and/or foreclose whether or not your friend makes the payments.

From the perspective of a borrower, it's not such a good idea to do what you did. Your credit can be tarnished by the late payments of your friend, because you're still liable for the mortgage!

The Answer : Let me guess....Over the past years you have been getting credit cards and rolling the balances over to them. Then you run up the other cards, get another card and roll over.....Am I close?Now you are looking at a home equity loan or a complete refinance. I'm not preaching to you. I've heard this story over and over. Let me jump to the ending of this story.....you will be filing bankruptcy in another year.

I know this because in the past 5 years this very thing has happened to thousands of other people. I've seen it. I've tried to help many people out of this.The only difference with you is your credit card rates are great! Assuming they all average about 9% as you say. Most people in your spot are paying over 20%.In your case, I don't really think refinancing is going to benefit you that much. The Answer : Once again, everybody gets this answer wrong (except for Spiff, of course).Just one of the problems here with Yahoo.....people can't take two minutes to research their answers. What really makes it sad....I've only posted this answer dozens of times. Go on...take a look at my answers! Amazing, isn't it? OK, once again...everybody open your books to the Fair Credit Reporting Act (see below). The reporting time for negative information on your credit report is 7 years, starting from the date of the delinquency.It makes no difference if it's paid off. If it's on longer then that, it's because the collection agency illegally re-aged the debt by reporting a fake delinquency date. The delinquency date is defined as the day you owed the payment, but didn't pay. Example, if you owed a debt on Jan 1, 2000 and missed that payment, THAT is the starting date. On Jan 1, 2007 the item must be deleted from your report.

I'm getting back on my feet now, and trying to repair my credit.I would like to request validation from my debtors, but haven't been in contact with them for over a year, I had to pull their address from my credit report...can I just randomly send them a request for validation? Or do they have to contact me first?My real concern is that I rec'd a letter from one debtor saying I have 30 days to dispute or it is legally validated. What if my other debtor sent me the same letter? They are saying I owe 5k more than I really owe. The Answer : Okey , you read the FDCA so that will help in answering your questions.That 30 day letter is a formality that they must send by law. If you do not respond, it is NOT an admission that you owe the debt. The FDCA states "The failure of a consumer to dispute the validity of a debt under this section may not be construed by any court as an admission of liability by the consumer."You have the right at any time to demand validation. You actually want to do this to make sure they collection agency is not taking on tons if illegal fees, as it sounds they are doing to you now. It also makes no difference if they contact you first or not....you said that you moved. They probably don't know where you are. But they sure will once you request validation information...so be prepared for collection calls.Be sure the send the letter by certified mail/return receipt.

The Answer : I do not agree with Marie's advice.If you are currently working and have some income, you probably will not qualify for chapter 7 anyway, and you could end up losing your home, auto, or other property. You need to discuss your options with a bankruptcy attorney. Only after examining your situation can any recommendation be made. As for the new rules, you must meat a "means" test to see if you qualify. If it's determined that you make too much money, and your dept ratio is not that high, you will not be allowed to file.The filing fees are a lot higher.You now have to complete budget management course (on your own dime). If you can't afford to consult an attorney then do some research on the net. I'm not sure how much info is available on the new rules yet though.Good luck, I've been there.

The Answer : Want an answer? Take one look at the number of personal bankruptcy cases file this year. Consumers are falling into a serious trap when they play around with credit. It starts with them making minimum payments. Then they get a second credit card and transfer the balance, only to run up the balance again on the first card. Then it's off to re-finance their homes. I've seen this over and over again!So the government is now forced to step in. Be lucky this is all they did.

I have been fighting BOA since 2005. I have all the documents sent to them so they can correct the adverse account entry on my credit report and they still give me the run-around. I tried writing to the credit bureaus too but all they told me was to write to BOA. I am tired of this game they are playing maybe it's time I sue them?


The Answer : If you have well documented proof that:-you did pay the bill-you did notify them of the error-you did dispute this with the credit bureau...then by all means sue them. There is a very specific procedure you need to follow, but if you do it you have a very easy small claims lawsuit, and you will win $1000 for your trouble (plus legal fees).If you don't want to fight this yourself...look in the phone book for a lawyer that specializes in collections.

Sure, they work for collection agencies, but these slimeballs will also eat their young, and will take your case. Many are even starting to do it on a contingency basis, where you pay the filing fees and they only collect when you win (because their fees are included in the suit). They see it as easy money. Where I live there are a couple who do nothing but these cases.

The Answer : Keep in mind that collection agents are notorious for not having a clue of the exact SOL date. You many need to research your state's laws a bit. If a lawsuit has already been filed, you may want to request a "discovery" and get all of the paperwork involved on your debt. You mainly want to see the last bill, the payment demand letter, and any docs to show when you last made a payment or charge to the account.Many times collection agents use the date that the account was charged off, or when they actually got the account. This will "pad" your SOL a few months, so it's possible you are actually over the date already and can use that as your defense.

The Answer : I like to call it "Credit Card Roulette"....eventually it will come back and hurt you.What many people do is get a new card, transfer the balance, then run up the first card all over again. Now they are in twice the amount of debt. Eventually the will file for bankruptcy.IF you have good self control, this isn't a bad idea. But over the long run it will start to hurt your credit.

I am 20 years old and my family always moved around a lot, because my dad was military, I recently applied for a few credit cards and all of them were denied, so I decided to check my credit report. Apparently there were 2 unpaid doctor's bills for $46 and $111, obviously if I knew about them, I would've paid them, they are very low amounts. I dont believe it is fair that they should be able to haunt my credit for 7 years because I didn't even know about them. If I pay the balances, is there a way to have them removed so they no longer have a negative effect on my credit? I hope someone can help me because this is really nerve racking! Thanks! =)

The Answer : First of all, you need to understand that there are only two ways to get negative information removed from your credit reports.

1) The creditor fails to respond to a dispute investigation from the credit bureau.

2) The creditor must remove it himself.Very important!!!! Just because you pay off a debt does NOT mean it will be removed from your report. All they are required to do is show the debt paid with a zero balance. But all other negative information will stay. That includes late payments, and the fact that it was charged off and went to collections. Anyone who tells you otherwise is lying, or just plain ignorant. Therefore, here is what you need to do.

Follow the dispute process. That involves sending a letter to the credit bureau and disputing the entry. Also send a demand to validate letter to the creditor, and make them prove that this is a valid debt. See the first link below for a flowchart and info on how to do this.If this fails, you will need to contact the creditor and arrange to pay off the debt. Fortunately it's not for a great deal of money. But remember what I just said....they don't HAVE to remove the negative information.

Therefore, as part of your negotiation to pay this off, demand that the credit delete this information, and get this agreement IN WRITING! If they refuse to do it, then DO NOT pay off the debt? Remember, the whole purpose of this is to clean up your credit report. If paying it off won't do it, why on earth would you pay off the debt?

I settled an dispute with verizon becuase they had sold my debt to a collector and now the collector damaged my credit score which is what I do not get since everything was fixed between me and Verizon. I recently paid the amount the collection agency wanted however the dispute was settled over 3 months ago. I just want to know how i can demand the collection agency to fix my credit score Since the problem had already been fixed. I just unfair that an $80 loan took 110 point off my credit score.

But all of the information about charge-offs and collections is still there.Therefore, you just paid off a debt and it's not going to do a whole lot to fix your credit. True, you can put a statement on your records but those statements are NEVER included into your credit scores. True, you can dispute it (probably your only chance now) and hope that they don't verify the debt. If so, it will remain on your records.You can try contacting the collection agency and ask them to delete it, but that's not likely either. Like, do you really think a collection agent is going to help you out....especially now that they already have your money?Lesson learned, you need to get the collection agent to agree IN WRITING to delete the entry once you have paid the debt. The Answer : I have to disagree with the Spiffman's answer.The new bankruptcy law changed the rules for refiling. If you have a chapter 7 an wish to file a new chapter 13 case, you must wait for 4 years from the date of the discharge of your previous BK.In researching this, there was a blurb about a change currently going through congress that would extend this to 8 years. I have not found any evidence to this yet but i'm still looking. As for a mortgage, it is extremely difficult to get a mortgage while you are in your chapter 13 plan. The ideas is that all of your disposable income is supposed to go toward your past debts, so your trustee is going to be upset to learn you have enough to by a brand new house????All of your creditors are going to dispute any such loan. But it does happen...you need to get it approved by the trustee and the court.As for paying...there are a lot of BK attorneys who will charge you a few hundred dollars up front to cover the filing fees. The rest of their fee is rolled into your Chapter 13 plan. At least most of the ones I've talked to do it.

am only 22 and have about $16,000 in debt. Alot of people say that's nothing but to me that is alot of money. I am really desperate cause I only feel myself falling more in debt. I am married and he takes care of everything, all the bills and anything that has to do with our baby. I pay for all my debt that was built up when I was single, I feel it's only fair that I pay for it since it was me that did the deed. So if anyone knows of something or someone that can help get out of debt quick, let me know.

Next letter now claimed the amount was $6500 but still didn't validate the debt with any proof. So we sent yet another letter to them. No response....one month later we get another letter from a 3rd collection agency! Yup...differant amount. Make them prove it!

The Answer : They don't throw people in prison for debts in this country, unless they can prove fraud. Did your friend take out a loan with the intent of not paying it? I don't think so.......If she comes back to this country they will be able to attempt to collect. And there are millions of people who enjoy seeing their rates increased to help cover these losses. Meanwhile, the banking industry enjoys record profits in the billions of dollars!

I paid off all my debt. I got a secured credit card for about 1 year and i charge it and then pay it off before the end of the month when they report to the beurus. really i only charge it so that way they keep reporting it. by the time they report i usually have a balance of 5-10 dollars. For the last (almost year) i have not only made the payments for my car on time but made many many extra payments to knock down the princible. Today i pulled my credit and i am at Experian 573Equifax 596Transunion 583what can i do to boost my score. i would like to be at least average. :)

No i do not have student loans. EVERYTHING is paid. I know one thing. if you do not charge on the card they will not report it. then the account looks stale lowering your score.Having a balance of 5 dollars on a credit card is not bad. it does not mean your in debt what they are looking for is having a high amount of credit you are approved for and not usuing it. so the more you have avaible and not use the better your score is. Pulling your own file does not make your credit score drop. that is credit 101.the bill is not due until the 5th of every month they report around the 27th. i make sure my payments are cashed around the 25th thus it is paid before they ask for it. Do you have some negative stuff on it? You make comments about paying off your old debt, does that mean they were in collection? It costs about $44 but with this site you will be given your report, scores, PLUS the reason codes that are on your report that discuss why your report is low.
