About SOL on credit card debt?
Here is the situation. Four years has passed and no payment has been made at all on the credit cards. What if within the four years the Company has sued the person before SOL is over and the person wasn't aware or know he has been sued because he was outside the United States sick. What will happen then? thank you
The Answer : As long as they file the lawsuit before the SOL expires you can continue to sue you.Also, when you leave the country the SOL is put on hold until you return....so once again you have no dodge for it.Did you get a default judgment against you yet? If you were out of the country and the creditor knew (or should have known) then how did they serve you with the summons? You may be able to fight a default judgment if you can show the judge the service was not done correctly.
