bankruptcy refinancing ! Included in bankruptcy?
We filed a chapter 7 bankruptcy in 1999. I just saw my credit reports and they show a hospital collection from 1997 on it. I called the collection agency to protest it. What else can I do to get it removed from my reports?
The Answer : The bankruptcy itself must stay on your report for 10 years. Any negative credit information can only stay on for 7. Your bankruptcy has no effect on this.So if this debt was prior to 2000, it must be deleted. Send the collection agency a certified letter and demanding that they validate the debt. But be sure to include a statement that this debt is over 7 years old, must be removed from your credit report immediately, and if it's not removed within 30 days you will file a small claims lawsuit for $1000 against them.
